Pakatan should study law before lodging complaints on electoral misconducts

13 March 2012

It is obvious that Pakatan Rakyat does not have any knowledge in running the government. Today, Pakatan Rakyat had failed to file a complaint on family members of military personnel being registered as postal voters in the Kuala Kubu Bharu constituency. Despite that, they had said that they will try lodging the report again. I therefore urge Pakatan Rakyat to study the Elections Act before they proceed to launch any complaints as it serves only to waste the public’s time and money.

Spouses of military personnel are indeed entitled to be registered as postal voters according to the Elections Act 1958, and the Registration (Registration of Electors) Regulations 2002, Section 2(b). Thus, I can only conclude that the federal opposition is only seeking to create issues to mislead the public that the coming 13th General Elections will be an unfair process.

Besides that, according to an Elections Commission officer, whenever Pakatan Rakyat fails to lodge a complaint, they must pay RM150 to the respondents as compensation for any inconvenience caused. However, Pakatan Rakyat does not have enough money to pay them thus leading to displeasure among the respondents at the hearing today. The respondents had nevertheless insisted that they be paid by today as any delay in payment will be unfair as they were needed to attend the hearing on time.

Here we can see that Pakatan Rakyat was willing to lodge complaints but unwilling to pay compensation. We can see that Pakatan Rakyat had hoped to discourage the spouses of military personnel from attending the hearing in order to prevent them from defending themselves against any slanderous accusations. This is simply irresponsible and is against proper procedures.

In my opinion, I believe that anyone who wishes to file a complaint should pay the compensation in advance to the Elections Commission in order to avoid any dispute of payment, as well as to prevent certain quarters from making up absurd complaints.

I also wonder if DAP Kampung Tunku state assemblyman Lau Weng San will decide to waste the public’s money by taking the compensation money from the Selangor state government to pay off the respondents.
